On Wednesday, the Pennsylvania Supreme Court overturned Bill Cosby’s sexual assault conviction, setting the stage for the 83-year-old comedian’s release later that day.
Cosby was charged with drugging and s*xually abusing Constand on his property in 2004. He was indicted in 2015 for the alleged attack and arrested just days before the 12-year statute of limitations expired.
Originally, the trial judge had allowed only one other accuser to testify at Cosby’s first trial. However, after the jury stalled, the judge allowed five other prosecutors to testify at Cosby’s retrial.

The state’s highest court dismissed Cosby’s conviction as a result of an agreement he had with a previous prosecutor that would have prevented Cosby from being criminally charged in the case. This new ruling prohibits any retrial in the case, court documents say.
Cosby has been in prison for two years from three to ten years.
The supreme court opinion also disagreed with the trial court judge’s decision to allow prosecutors to call five other prosecutors in addition to Andrea Constand, the former Temple University employee, whose prosecution was the basis for the criminal case.
However, Pennsylvania’s highest court ruled that a settlement with a previous prosecutor prevented the former actor and comedian from being charged in the case. In their decision, the judges also found that the testimony of accusers outside the case had contaminated the trial.
“Cosby’s convictions and sentencing ruling are set aside and he is released,” the court’s 79-page ruling reads.
