Tom Carney went to the home of 76-year-old David Phillips to perform sexual acts in exchange for alcohol, but then returned to launch a brutal attack, leaving Mr. Phillips horribly wounded.

Attorney Patrick Harrington QC said: “Tomas Carney deliberately inflicted the most cruel, sustained and brutal attack on his victim, and by doing so, in a controlled and anger-fueled manner, chose to end the life of another person.”

Swansea Crown Court heard that Carney had previously been a talented sportsman and played for the Ospreys youth rugby player. He visited Phillips’ home in Cimla, Neath, South Wales, on Valentine’s Day 2019.
The court heard that Carney agreed to go to the flat to perform sexual favors in exchange for alcohol. Mr. Harrington told the jury: “The fact is, Tomas Carney has wasted his life. He scrapped a career as a rugby player in which he could have accomplished great things.
“He has the discomfort of knowing that he is one of those ‘could have been.’ Pathologist Richard Jones said that he visited the scene the next day and saw Mr. Phillips with a “very distorted” skull.
Phillips also suffered a fractured spine, 27 broken ribs and bruises to his genitalia and pelvic area from the savage attack. Carney claimed that Mr. Phillips was his sponsor in Alcoholics Anonymous and had offered to help him after a relapse.
He said that Mr. Phillips “abused his trust” by drugging and raping him. Carney, of Morriston, Swansea, pleaded guilty to manslaughter on grounds of diminished liability. But a jury rejected him and convicted him of murder. Judge Paul Thomas QC jailed Carney for life with a minimum of 15 years and 10 days.

The first officer to deal with him, South Wales Police CP Donald Beare, said that during the murder trial Carney looked “very scared” and “shocked”.
Carney initially gave the police a false name, claiming his name was Jeremy, and told officers that someone had tried to rape him. After it was confirmed that Mr. Phillips had died from his injuries, the defendant was arrested and taken to Swansea Central Police Station, where he directed his assault on the officers.
He refused to get out of the police van until he was given a cigarette and then launched a tirade of insults directed at the officers threatening to “crush them” and “strangle you to death.”
He then he started screaming: “They raped me before and you are defending him”, adding: “He was trying to rape me” and “I’m straight as f **** â €.
He yelled at the officers: “I smashed his head!”
Once inside the station, Carney urinated in a holding cell before spitting in the face of an officer; That assault was the beginning of a violent fight that saw the alarm sounding in the custody room and more officers rushing to help his colleagues.
