The official misdemeanor is a felony of the second degree.
The Attorney General alleges that while Kealy was assigned to the Essex County Narcotics Task Force, he purchased, installed and connected a GPS tracker to a vehicle that belonged to a civilian suspect. He did not have the formal or legal authority to do so, the office says.
Generally, a supervisor must sign such an investigation step and then ask a judge to sign an appropriate court order.
The Essex District Attorney’s Internal Affairs Division began investigating Kealy in January 2020 and the Attorney General prosecuted him in July 2020.
Kealy remains suspended without pay, a spokesman for the prosecution said Monday.
Patrick Toscano, Kealy’s attorney, said of the development: “You can load a radial tire. It does not mean anything. In fact, it is the constitutional law of the accused. ”
“However, the accusations in this case are absurd and absurd. Detective Kealy has been a phenomenal law enforcement officer for years. This obvious truth cannot be denied, ”Toscano said.
