Lorena Delaguna, of Queens, New York, has been charged with attempted battery as a hate crime after she threw a bottle at a black runner while calling it the “N word,” police say.

Queens District Attorney Melinda Katz announced on September 22 that the 53-year-old had been arrested on charges of attempted second-degree assault as a hate crime. and second-degree aggravated harassment, derived from the August 17 incident.

“In addition to allegedly shouting the N word, the defendant in this case is also accused of throwing a bottle in an attempt to hit the victim. Crimes like this, which are fueled by hate, are in a special category for a reason, ”Katz said in an online statement.

“No one should have to endure being called a vile insult or attacked simply because of their skin color, their religion or who they love.”

Delaguna was arraigned that morning and ordered to return to court on Sept. 25, according to the district attorney’s office. She was booked into the Rose M. Singer Center, arrest records show.

As of Tuesday night, Delaguna had not yet posted the bond, which was set at a $ 5,000 insurance bond, $ 2,500 in cash or $ 5,000 in partially guaranteed bond, The New York Daily News reported.

If convicted, she could face up to seven years in prison, the newspaper added.

On the afternoon of Aug. 17, Tiffany Johnson went for a jog in Woodside, Queens, she wrote on Facebook.

The 37-year-old later claimed Delaguna harassed her because of the “color of [my] skin,” writing:

This incident happened to me while I was running in 98 degree weather going about my business. I had no idea someone was filming this, it literally came out a month later and is now viral on the internet. I filed a police report. At the time her hair was blonde and short, but she may have changed it since.
As a black woman, I am always cautious because I know that my skin color kicks in for certain people.

The district attorney’s office said Delaguna threw the glass bottle at Johnson, which broke near the corridor and splashed liquid on him.

Prosecutors also accused Delaguna of cursing and using racial slurs toward Johnson, “telling him to get out of here and go back to Africa and calling her the N word,” according to the press release from the district attorney’s office.

Delaguna then proceeded to follow Johnson for at least a block as he continued to threaten her, the statement continued.

According to his Facebook page, Delaguna graduated from LaGuardia College in 1988.

She also previously worked at State Auto Group, the page continues.

Reservation information from the New York City Department of Corrections indicates that Delaguna was born in 1967 and is of Colombian ethnicity.

During a virtual appearance on Sept. 22, Queens Criminal Court Judge Jeffrey Gershuny stated that the “damage” does not have to be physical, The New York Daily News reported.

“The damage does not have to be cuts and scratches,” he said, according to the newspaper. “I find that in this case in which it is alleged that the defendant threw a glass bottle … and then [to get the victim yelled at], threatened and followed, I find that it is harm directed at an identifiable person” .

Gershuny also noted that “there is a mental health component here” and ordered a mental health evaluation for Delaguna, The New York Daily News reported.

“There is a mental health component here and that is all the court is going to say about it,” the judge said. “I’m really taking everything into consideration in its entirety.
