More than two months later, the cause of death has yet to be publicly revealed, but investigators are said to be treating it as a possible homicide. Investigators first believed that Sicknick was hit in the head with a fire extinguisher, based on statements collected at the beginning of the investigation.
However, a video shows Khater and Tanios standing near Sicknick and other officers on the Lower West Terrace of the Capitol during the insurrection, according to court documents obtained by the Post. Prosecutors said Khater could be heard telling Tanios, “Give me that bear shit.”
About nine minutes later, Khater was allegedly seen discharging chemicals believed to be bear spray into the faces of Sicknick and two other officers.

“Give me that bear shit,” Khater allegedly told Tanios in a video recorded on Capitol Hill at 2:14 p.m., where Sicknick and other officers were standing guard behind metal bike racks, arrest documents say, reported the post. About nine minutes later, after Khater said he had been beaten with bear spray, Khater is seen in a video unloading a canister in the face of Sicknick and two other officers, according to arrest documents.
Khater and Tanios are charged with nine crimes related to the January 6 attack, including assaulting Sicknick and two other police officers.

Khater and Tanios each face nine charges, including assaulting Sicknick and the other two officers with a deadly weapon, civil disorder and obstruction of congressional proceedings. The men are expected to make their first court appearance Monday afternoon.
Court documents say the men were detained after informants contacted the FBI and identified them on “wanted” posters posted by authorities.

Sicknick, who was 42 at the time of his death, died on January 7, hours after confronting supporters of Donald Trump on the United States Capitol. Capitol Police said he “was injured while physically interacting with protesters” and collapsed after returning to his office after the riots.
Initial media reports suggested that Sicknick had died from injuries sustained when he was bludgeoned by a fire extinguisher during the chaos. But sources close to the investigation recently told the Post that Sicknick did not die of blunt trauma, calling into question the entire extinguisher narrative.
Authorities have yet to release an autopsy on Sicknick as the investigation continues.
