Drayton Manor theme park to be prosecuted under health and safety laws after drowning death of 11-year-old schoolgirl Evha Jannath on one of their water rides

A theme park will be prosecuted for alleged health and safety violations following the 2017 death of Leicester schoolgirl Evha Jannath, it was confirmed today.
Later, an investigation declared that her death had been “accidental”.
However, the Health and Safety Executive confirmed today that it is about processing the business.
No date has been set for any hearing. Evha’s family, who live in the Belgrave area of the city, have welcomed the decision.
Her brother, Mohammed, said: “We would like to thank the police, our attorneys and the community for their help.
‘We have lost our dear Evha forever. Nothing will bring her back.
Former MP Keith Vaz took up the case when he represented the Leicester East constituency and continues to support the family.
Mr. Vaz said: “You are pleased that this matter is coming to an end.
“It has been a sad time for them and they regret that they have been through this ordeal.”
An HSE spokeswoman told LeicestershireLive: ‘An indictment by the Health and Safety Executive is being initiated following the death of an 11-year-old girl at Drayton Manor theme park.

On May 9, 2017, Evha Jannath died after falling from Splash Canyon water park.
“Drayton Manor Park Ltd of Drayton Manor Drive, Tamworth, Staffordshire will face one charge under Section 3 of the Occupational Safety and Health Act.”

An investigation heard in November 2019, three teachers rode in the same boat, while nine students were ahead of them in two separate boats on May 9, 2017.
It was reported that Evha got to her feet at the worst possible moment, when the boat collided with a barrier and was pulled from the boat.
The 11-year-old was seen wading through water up to her thighs, but then disappears from sight.
It is believed that she tried to climb a ‘travellator’ that collects the six-seater boats and fell overboard into the plunge pool.

Resuscitation attempts were made and she was airlifted to Birmingham Children’s Hospital.
Evha, who lived with her mother and brother in Leicester, died four days after her birthday.
Although she had several fractures, drowning was attributed to her as the cause of her death in May 2017.
Speaking at the time of her death, Evha’s family said that their world had been “shattered”.
They added: ‘Evha was a beautiful girl who was full of love and always smiling.
“Words cannot describe the pain and loss we feel, we are devastated that we will never see our beautiful girl again.”
Following the conclusion of the investigation, South Staffordshire Coroner Margaret Jones wrote a Future Death Prevention Report for UK theme park managers.
The report urged theme park operators to address concerns about the safety of water rides to ensure similar incidents do not occur in the future.
