“The world has lost a wonderful, sweet and vibrant young woman,” Woodruff said. “She had a life ahead of her that was cut off unnecessarily.”

Her family had previously taken legal action against Kim and anesthesiologist Rex Meeker, accusing them of gross negligence.

Now, after the loss, Woodruff has said they will continue the trial as a wrongful death trial.

“Emmalyn’s parents believe that telling Emmalyn’s story is essential to doing her justice and preventing this from happening to another patient,” Woodruff told KCNC.

Kim had temporarily suspended her medical license, but she was reinstated earlier this year and will be allowed to practice on probation for the next three years, media reported.

“They killed my mother, 100%,” Swenson said. “She would be alive today if they had properly fulfilled their responsibilities.”

State records show that the case did not trigger any state disciplinary activity against Meeker. Meeker did not react to numerous calls and instant messages from CBS4 seeking information. A call and email were also not returned to a lawyer who agreed to speak with Meeker.

These days, Lynn Fam is constantly visiting her little girl’s bedside, brushing her little girl’s hair, modifying her cushion and keeping expectations.
