Dr. Olajide Ogunjimi was acquitted of misconduct by a disciplinary panel after it agreed that the two officers acted “unreasonably and disproportionately” against him when they arrested him on suspicion of wasting police time.

The 47-year-old doctor was arrested after he called police to report an unknown concern and then refused to end a phone conversation he was having while being questioned.

Ogunjimi, a former intern at Bolton Hospital in Greater Manchester, struggled with the two officers in his room before being subjected to CS spray, also known as tear gas.

Later, senior officers concluded that no action would be taken against the father of three on the charge of wasting police time, but he was reported to the General Medical Council.

At the Manchester Medical Practitioners Court Service, Dr Ogunjimi, who also works as a professor at the University of Central Lancashire, faced misconduct charges.

But he was acquitted after accepting that the officers acted “unreasonably and disproportionately.”

Arrested

The 47-year-old doctor was arrested after he called police to report an unknown concern and then refused to end a phone conversation he was having while being questioned.
A disciplinary panel concluded that the arrest was legal, but said it considered the officers to be “clumsy” and ruled that the doctor was in a “unique situation that was unlikely to recur.”

It is not known why Dr. Ogunjimi had called the police at his home, but the court heard that it came after telephone conversations he had with his uncle and an unidentified woman.

The incident occurred on June 8, 2018 after the two officers, a young police officer known as PC A and PC B, an experienced Neighborhood Response agent, were dispatched to Ogunjimi’s home.

Initially, he chatted amicably with the two officers for up to 30 minutes in his classroom, but the problems began when he received another phone call from an unknown person.

PC B himself ended the call, but the doctor became “agitated” and “frustrated” and went upstairs to make another call.
The doctor, a former trainee registrar at Bolton Hospital, Greater Manchester, was arrested on June 8, 2018.

One of the officers urged Ogunjimi to stay in the living room and accused him of being rude, but he went up the stairs anyway and the couple ran after him.

PC B followed him into the bedroom, warned him, and asked the doctor to end his phone call, but a fight broke out when Ogunjimi ignored him.

As it stirred further, PC B directed PC A to deploy the CS aerosol.

Dr. Ogunjimi’s attorney, Mr. Phillip Bown, told the court: “The police officers used an unreasonable, unnecessary and disproportionate amount of force in arresting Dr. Ogunjimi.

Following his arrest, Dr. Ogunjimi was not charged with the crime for which he was arrested or with any other crime resulting from his arrest.

His behavior, in the heat of the moment, while he was in shock and suffering from pain in his wrist, was legal and excusable.

This was a once-in-a-lifetime situation that Dr. Ogunjimi found himself in.

“The incident was a single error in judgment committed in a very short space of time and under highly charged emotional circumstances.”

In clarifying Ogunjimi, MPTS President David McLean said: ‘PC B’s genuine belief was that Dr. Ogunjimi was being a fake, his story was made up and that he was wasting the time of the police.
