The suspect in the fatal stray bullet shooting of 1-year-old Davell Gardner in Brooklyn was charged this week in connection with the boy’s death, police said Thursday.
Dashawn Austin, 25, was hit with multiple blows, including the wanton and depraved murder of a boy under the age of 11, in the July shooting of the baby during a cookout at Raymond Bush Playground on Madison Street and Marcus Garvey Boulevard in Bedford-Stuyvesant, police officers said.

Arrested
Dashawn Austin, 25, has been arrested in connection with the death of Davell Gardner, Jr.
“This is a powerful moment of justice,” Mayor Bill de Blasio said of the arrest. The mayor recounted spending time with the boy’s mother and grandmother and said: “He was the most heartbreaking thing in the world.”
The 1-year-old was hit by a bullet when shots were heard on July 12, 2020, during a barbecue near the Raymond Bush Playground in Bedford-Stuyvesant.
Police say two gunmen dressed in black approached and fired several bullets before fleeing. Little Davell was shot in the abdomen and died of his wounds. Three others were also wounded by gunfire.
The boy was only two months away from his second birthday.
Shooting and Charged
Austin is now charged with multiple crimes, including three counts of murder, three counts of attempted murder, assault, two counts of attempted assault, four counts of criminal possession of a weapon by having a loaded firearm, and reckless danger.
Days after that shooting, Austin was arrested in connection with the murder of 26-year-old Janile Whitted in March 2020 in front of Amour Cabaret on Nostrand Avenue near Herkimer Street in Bedford-Stuyvesant, cops said.
He was charged with murder and criminal possession of a weapon in connection with that case.
Suspect
Davell was hit by a stray bullet in Brooklyn.
At the time, he was being viewed as a suspect in Davell’s murder. Those charges were brought against him Wednesday afternoon while he was in custody in connection with the earlier murder, cops said.
