Crosley Green, 63, was convicted of murdering Charles ‘Chip’ Flynn Jr, who was found by police dying of gunshot wounds in a Florida citrus grove in 1989.

Green was chosen from a lineup by Flynn Jr’s ex-girlfriend, Kim Hallock, who had been with him the night she died.

She claimed that a black man had hijacked a truck and kidnapped them both, before driving into the grove and shooting him, CBS News reported.

Police arrived and found Flynn Jr dying from gunshot wounds, but he refused to tell them what had happened.

Florida Department of Corrections inmate number 902925 had spent more than 30 years behind bars.

Green, a small-time cocaine dealer with a previous prison term of only six months, was sent to Florida’s death row on February 20, 1991 for the murder of Charles “Chip” Flynn. His death sentence was later commuted to life in prison for kidnapping and murder.

Green always maintained his innocence, and his conviction was overturned in July 2018 after an appeals court found that prosecutors withheld evidence from defense attorneys at his initial trial.

The state appealed the verdict and Green had languished in prison while the state Court of Appeals for the 11th Circuit decided whether he should be tried again.

The law firm of Green, Crowell and Moring, has again called for his release “before COVID-19 potentially makes the search for him to prove his innocence moot.”

After contracting tuberculosis and being placed in medical quarantine, his lawyers told the court that Green was closer to death than he was on death row.

On Tuesday, Federal Judge Roy B. Dalton granted a motion to release Green based on concerns about the pandemic, the length of time Green has been in prison and his conviction overturned.

The judge said Green “poses no danger to public safety” and that the director of the Calhoun Correctional Institution described him as a “model prisoner” where he was being held.

“In addition, the public has a great interest in the release of a prisoner who the Court has determined is incarcerated in violation of the Constitution,” Judge Dalton said.

Green had recently been exposed to tuberculosis and was receiving treatment for the disease, his attorneys said.

He will be released to live with a brother in Mims, Brevard County, and will be monitored with an ankle bracelet.

Green’s law firm Crowell and Moring, which succeeded in getting his client off death row in 2008, welcomed his release.

They said there was no direct evidence linking Green to the murder, and that the newly discovered evidence shows that he was wrongfully convicted.

Green was a model prisoner at the Calhoun Correctional Institution, according to Judge Roy B. Dalton.

Green, photographed in the 1980s, has always maintained that he was at a party the night Flynn Jr was killed.

Green spoke to CBS 48 Hours in 2020 while he awaited developments on his appeal.
