Who is Codey Herrmann?
The man who savagely raped and killed international student Aiia Maasarwe in Melbourne will not have his prison sentence increased.
Victorian prosecutors appealed the maximum sentence of 36 years handed down to Codey Herrmann for the horrific rape and murder of Ms Maasarwe in January 2019.
The director of the Public Ministry argued that Herrmann should have received a life sentence for his crimes.
“This was a cruel, cruel and intentional murder of an unsuspecting young woman who was the unfortunate and random victim of primitive male rabies,” Kerri Judd QC had argued.
But five judges of the Court of Appeals unanimously rejected and dismissed the appeal on Friday afternoon, saying that, from any point of view, the sentence, including a minimum period of 30 years, represented severe punishment.
His judgment highlights the importance of access to rehabilitation services within Victorian prisons, and points to the belief that Herrmann has a fair prospect of rehabilitation if he is provided with proper treatment, support and supervision.
Appellate judges said it was a cry from modern governments that community safety is the first priority.
How old is Codey Herrmann?
He is 36 year old.
Aiia Maasarwe 21 was on her way home to Melbourne in January 2019 when she was raped and murdered by Codey Herrmann after getting off a tram in Bundoora.

“Accepting that this is the case, protecting the community requires that offenders like (Herrmann) have access to the specialized treatment and support services on which their rehabilitation depends,” they said.
“Of course, he must remain willing to participate in treatment, but the onus lies with the state, which monitors his incarceration, to ensure that he is available.”
Ms. Maasarwe had arrived in Australia in August 2018 on a one-year exchange program with La Trobe University in Bundoora.

She was on her way home from a night out, on a call to one of her brothers in Israel, when Herrmann attacked her.
“I didn’t expect you to answer,” was all Ms. Maasarwe managed to say before the phone hit the ground.
Her last words to her attacker were: ‘piece of shit’ in Arabic.
Herrmann knocked the 21-year-old unconscious with a metal pole, sexually assaulted her and set her on fire.

The appellate judges rejected Ms. Judd’s argument that Judge Elizabeth Hollingworth’s sentence had put too much weight on Herrmann’s trauma and disadvantaged record, and not enough on protecting the community.
Herrmann was homeless at the time. He had a history of substance abuse and a severe personality disorder.
A forensic psychiatrist said the trauma, abuse, neglect and deprivation that the young indigenous man had experienced was so extreme that the damage had already been done by the time he was two years old.
Arguing against the appeal, Herrmann’s attorney, Tim Marsh, said the sentence was harsh.
Since Herrmann’s prospects for rehabilitation were not extinguished, it was impossible to say whether he would always be a danger to the community, he said.
