Who was Carrie Cabri Witt?
An Alabama teacher who claimed it was her constitutional right to have sex with two students was sentenced to state prison.
Carrie Cabri Witt was sentenced to 10 years in prison Thursday, according to the Decatur Daily, WAAY and WHNT reports. However, Witt would only spend 18 months in state prison, followed by 18 months in a local correctional program. She is serving the remainder of her sentence on probation.
Witt pleaded guilty in March to charges against a school worker who had acted sexually with a student under the age of 19. The prosecution denied a second accusation.
The 48-year-old woman was arrested in March 2016 and charged with having sex with two students, ages 17 and 18. She was a teacher at Decatur High School.
After her arrest, Witt’s attorneys argued that she had a constitutional right to have sex with students. Under Alabama law, anyone over the age of 16 can give her consent to have sex without a specific disease.
Her attorneys argued in court documents that state laws prohibiting a school employee from having sex with a student were unconstitutional. They argued that there are other laws that protect people who cannot consent because of age, developmental disability, physical disability and in cases of coercion or fraud, but that none of these clauses apply in this case.
However, prosecutors disagreed, arguing that the law was constitutional and necessary to protect high school students from sexual advances by teachers and other school employees.
According to court documents, a judge refused to dismiss the case. Witt later pleaded guilty at her scheduled trial.
Following her arrest, Witt apologized for her actions.
“I’m ashamed,” she told the judge, the Decatur newspaper reports. “I don’t think I’ve ever felt more ashamed of myself.” Since her arrest, she has claimed that her character and “her ability to be a mother” have been criticized.
According to the newspaper, one of the victims stated Thursday that she did not agree with the law that prohibits teachers and school employees from having sex with students.
“Crime does not correspond to punishment,” she said, defining consensual sex.
Witt faced up to 20 years in prison. As part of her sentence, she must register as a sex offender.
