As previously reported by CrimeOnline, Brittany Smith was charged in March 2018 with the murder of Joshua Todd Smith. Months earlier, in January 2018, Brittany shot and killed Smith at her home in Stevenson, after allegedly twice raping her, beating her and threatening to kill her family if she told anyone.
Brittany told investigators
According to police, Brittany told investigators that Todd Smith turned violent after telling her that she was not interested in a relationship with him. Out of fear, he allowed her to sleep on his couch at night, but sent secret messages to his mother after the attack.
“Todd tried to literally kill me. “Don’t act like something’s wrong; it’ll kill me if it knows,” Brittany reportedly texted her mother at the time.
CrimeOnline had previously spoken with Brittany’s mother, Ramona McCallie, who explained that her daughter allowed the man to visit her home after texting and saying he was caught out in the cold. At the time, Brittany had no idea that Todd Smith was going to be violent.
“This afternoon, Todd texted her to tell her that she was wrong, that she was cold and that he was playing with her, he likes having her, he said he had nothing to go to,” explained Ramona McCully. “Then she told him that he could sleep on her couch, but that he had to go in the morning.
“Todd has been called, told to leave several times. He held her captive in HIS home for about 4.5 hours that night and told her that he would kill her if she told anyone. He had her phone and wouldn’t let her call anyone until she ran out of cigarettes.
Brittany texted her mother
Shortly after Brittany texted her mother, Brittany’s brother, Christopher McCallie, 26, came home with a gun. She put it on the table and ordered Todd Smith to leave, according to what Brittany told the Jackson Sheriff’s Department.
There is a confrontation. Smith allegedly attacked Christopher McCully and put him in a bind. According to Romana McCallie, her daughter took her brother’s gun and gave him several warnings before the shooting.
“When her brother came back, she told [Todd Smith] to go and attacked her. They fought between a block full of knives and the gun on the bench. My daughter was terrified but gave her several warnings before she fired the pistol … I wasn’t even sure I shot her because she was still fighting. ”
Al.com reports that British lawyer Ron Smith made a deal with the prosecution, which required his client to plead guilty to murder in exchange for 20 years. If found guilty at trial, Brittany Smith would likely have a life sentence.
“Either way, you have to weigh what you know and check what you can’t,” Ron Smith told Al.com.
Although Brittany Smith originally supported Stand Your Ground, Jackson County Judge Jennifer Holt ruled that the defense was invalid because Christopher McCully brought a gun to Brittany’s home.
Additionally, Holt wrote that Brittany Smith’s story has changed many times, tried to change the facts, and did not provide enough information to show that the discharge was justified.
“The court finds that the defendant gave inconsistent accounts of the events surrounding Todd’s death, beginning with calling 911 … and attempting to tamper with or destroy evidence.”
Holt also wrote that while a medical examination revealed that Brittany had been physically assaulted, “the physical evidence is inconsistent with the defendant’s statements about the sexual assault.”

Trauma nurse Jeanine Suermann, who was in Brittany after the incident, said that while she couldn’t determine with absolute certainty that the rape had taken place, that didn’t mean it wasn’t. Suermann reportedly said that most cases of rape and sexual assault had no evidence.
The Mail Online reports that Todd Smith had a long criminal history, with 71 arrests since 1999. In 2002, he was arrested five times while marrying his ex-wife, Paige Johnson. Smith was reportedly charged with assault in 2012, 2015 and 2016, but two of the three charges were dropped when the defendant failed to appear in court.
