Charged – Arrested

The city of Los Angeles was horrified on April 9, 2015, when a man, Ali F Elmezayen, pulled his wife and two autistic children from a dock in the San Pedro port district to defraud insurance companies. Elmezayen’s children, Elhassan, 13, and Abdelkarim, 8, both suffered from autism, died during the incident, while his ex-wife, Rehab Diab, managed to escape, despite not knowing how to swim.

Elmezayen applied for and purchased more than $ 3 million in life and accidental death insurance coverage for his family with eight different companies. Elmezayen, who is a native of Egypt with no legal status in the United States and a reported income of less than $ 30,000 per year, paid annual premiums of $ 6,000 for these policies. He began purchasing insurance policies after a Chapter 11 bankruptcy proceeding. After the death of his children, he raised nearly $ 262,000.

According to a court proceeding on Thursday, March 11, United States District Judge John F. Walter sentenced him to 212 years in prison, the maximum penalty allowed by law, due to the “cruel and callous nature of his crimes.” . The judge also added that “he is the ultimate phony and a clever liar … and he is nothing but a greedy and brutal killer.”

“He murdered his two autistic children, leaving two innocent young men to die in an extraordinarily painful way while they were tied up in their (car) seats,” Judge Walter told the court. “It is indisputable that dying by drowning is a painful way to die. I can only imagine the horror they must have experienced as they struggled to get up from their seats … as their lungs filled with water, “he said, according to a report.

In addition to his sentencing, he was also ordered to pay $ 261,751 in restitution to the insurance companies he defrauded. The trial took place in October 2019 and lasted nine days, where a federal jury found Elmezayen guilty of four counts of mail fraud, four counts of wire fraud, one count of aggravated identity theft and five counts of money laundering.

Investigation report

Elmezayen often contacted insurance companies and even posed as his ex-wife, under whose name he purchased some of the policies, to check on his status and confirm if there would be a payment in the event of accidental death. He also called and confirmed with two agencies that they would not investigate claims made after two years of the policy purchase period.

The FBI Criminal Investigation and IRS investigated the case and he was subsequently arrested in November 2018. He has been in federal custody ever since.
